Supreme Court’s Decision Could Restore Fairness and Accountability in Congress

For decades, the federal government has required states to create “majority-minority” districts, claiming it ensures fair representation. But as former Deputy Assistant Attorney General and Berkeley Law Professor John Yoo explained on Fox News, the Constitution itself bans government from using race to determine how we treat one another. He emphasized that these race-based remedies were originally designed to correct the injustices of slavery and segregation, not to become a permanent part of American law.

“The Constitution wants all of us to treat each other the same regardless of our skin color,” Yoo said. “Those remedies were meant to end. It’s been 60 years, and this should not go on forever.”

If the Court rules to end the use of race in redistricting, it could reshape the balance of power in Congress. Analysts believe the GOP could gain as many as 19 additional House seats if states are no longer required to gerrymander along racial lines. That would restore a more accurate reflection of communities and voters, rather than political divisions created by Washington bureaucrats.

As Yoo pointed out, the current system often assumes that people of one race will only vote for candidates who look like them. “That view is offensive,” he said. “It assumes people think alike because of their skin color. The Court wants to end that practice.”

A ruling in favor of a color-blind Constitution would allow states to draw maps based on fairness, geography, and community—not ideology or race. It would reaffirm the founding principle that all Americans are equal under the law.

This case is about more than maps. It’s about whether we continue dividing Americans by race, or move toward a future where equality is truly applied to all.
